CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 5 8 8 ( <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 78-305, 78-1279 & 78-1288 <br />AND A CONDITIONAL USE PERMIT <br />PURSUANT TO MUNICIPAL ZONING CODE <br />SECTION 78 -966 <br />FILE NO. 09 -3428 <br />WHEREAS, The Estate of Esther M. Addison (hereinafter "the Owner") is the <br />owner and Michael Huthwaite and Marilyn Huthwaite, husband and wife, (hereinafter "the <br />Applicants") have an interest in the property located at 3382 Bayside Road within the City of <br />Orono (hereinafter the "City") and legally described as follows: <br />Lots 8, 9, 10, and 11, Block 5, Bayside Addition to Lake Minnetonka, Hennepin <br />County, Minnesota (hereinafter the "the Property"); and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-305 (B) to allow construction of a new <br />home at 3382 Bayside Road which consists of four separate tax parcels totaling 34,400 square <br />feet in area where 87,120 square feet in area is required; and <br />WHEREAS, the Applicants have made application to the City of Orono for <br />variances to Orono Municipal Zoning Code Section 78-305 (B) to allow construction of a new <br />home 48' from Crestview Avenue where a 50' setback is normally required and 11 ' from the <br />north side lot line where a 30' setback is normally required; and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1279 (1) to allow construction of a new <br />home 60' from the OHWL of Stubbs Bay Creek where a 75' setback is normally required; and <br />WHEREAS, the Applicants have made application to the City of Orono for a <br />variance to Orono Municipal Zoning Code Section 78-1288 to allow 6.57% hardcover within the <br />0-75' creek setback where 0% is normally allowed and to allow 33 .3% hardcover within the 75'- <br />250' setback from the creek where 25% hardcover is normally allowed in conjunction with the <br />construction of a new home on the property and the installation of a footbridge crossing the <br />creek; and <br />Page 1 of 7
