MINUTES OF A PLANNING r0 MNISSION MEETING HELD ON -"'W 25, 1979 <br />PACE 4 <br />.A.pplicant was not present. The application was <br />tabled until the next meeting. <br />Applicant was present. Planning Commission <br />questioned whether the applicant intended to build <br />on this 1-' ;,perty themselves and they were informed <br />that they d170 not but their intention was to finally <br />clarify wheLher the City deemed this lot buildable <br />for a year-round home. They presently live at the <br />subject property seven months of t'ie year but because <br />of age return to a warm-r climate in the winter. <br />Planning Commission reviewed the need to set a new <br />structure 75' from the lakeshure. The applican <br />questioned that requirement as tine neighboring houses <br />are no more than 35'. Planning Commission stated <br />that for the past five years no new construction has <br />been allowed within the 75' setback. <br />Gregg Hannah moved to recommend approval of the lot <br />area variance finding the hardship of no adjacenL <br />land being available and the existing cabin is <br />connected to sewer, conditioned upon: <br />1) Any new structure must be constructed without <br />any setback variances. <br />2) Any new structure must be designed to meet <br />a hardcover limitation of 1,538 s.f. <br />3) Prior to issuance of building permit, the Shed <br />and existing structure must be removed. <br />Motion seconded by Jabbour. Vote: Ayes (6), <br />Nays (0). Motion passed unanimously. <br />Mr. Nyquist was present. Planning Commission <br />questioned the applicant as to need for expansion <br />on ground level since the majorlty of the addition <br />involved the second story. Mr. Nyquist explained <br />that the family living area was cramped and small <br />and the first floor expansion would "s(piare off" <br />the existing dining and living room area. It was <br />noted at this point that the applicant had made <br />every attempt to live within the setback requirements. <br />The hardcover encroachment into the 75' setback area <br />was tT,inimal and does not have a negative effect on <br />JACK SA FAR <br />925 fartenwood Road <br />VARIANCE <br />(#485) <br />FRA NCIS A.
