Section 10.25, Subdivision 1 - Purpose of LR-IC District. <br />One family lakeshore residential district is intended to <br />provide a district which will allow a combination of medium <br />density residential development and limited agricultural <br />activity. Planned Residential Developments may be allowed <br />by conditional use permits. The proposed land use may not <br />endanger the quality of storm water run-off ±nto Lake <br />Minnetonka. Because of the location of the district near <br />Lake Minnetonka, special regulations are necessary to <br />protect that natural resource from the effects of intense <br />development. The district shall have immediate access to <br />highways and public sanitary sewer. <br />8. Section 10.03, Subdivision 6(b) - Combination of Separated <br />Parcels Prohibited. No lot or parcel of land which is <br />divided by a public, private or platted road or road <br />easement which results in any segment thereof being less <br />than the minimum acreage required for that zoning district <br />shall be allowed to be combined with any separated parcel of <br />land across the road for purposes of q'ualifying under the <br />minimum acreage, open space, required yard, setback or <br />sanitary or a septic system requirements, nor shall building <br />or density credits be credited or transferred between such <br />parcels under any provision of this Chapter. Each separate <br />parcel must individually conform to the provisions of this <br />Chapter in connection with construction of improvements <br />thereon. <br />Review of Current Application - <br />The applicant proposes the legal combination of the original <br />platted lots of the Baldur Park plat (Exhibit C), into four <br />building sites. Staff shall reference the follow ng combined <br />lots as follows: <br />Lot <br />1 <br />- Combine <br />Lots <br />21, <br />22, 23, 24 <br />Lot <br />2 <br />- Combine <br />Lots <br />25, <br />26, 27 <br />Lot <br />3 <br />- Combine <br />Lots <br />28, <br />29 <br />Lot <br />4 <br />- Combine <br />Lots <br />31, <br />32, 33 <br />It is the intent of the applicant and new owner to build on <br />the legally combined lots without further subdivision. Legally <br />platteu public roads to the individual sites are now inundated <br />with water or have been vacated. The lots as currently platted <br />do n,)t have a platted access. All lots are technically <br />landlocked in consideration of the current Code. Staff's <br />understanding of the applicant's position is that because the <br />lots are legally platted that they have a right to be developed <br />without the reed for further subdivision. Lacking a written <br />addendum, it would he appropriate to ask the applicant to <br />comment. <br />
