cite of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />1. The retaining wall shall extend no closer than 70' from <br />the shoreline, per the recommendations of the City Engineer. <br />2. Fill to be placed on the property shall extend no closer <br />than 40' from the shoreline. <br />3. Applicant shall generally adhere to the grading and <br />retaining wall plan attached hereto as Exhibit A. <br />4. Only clean fill as defined in the Zoning Code shall be <br />placed can the property. <br />5. Suitable e.rosie- controls shall be maintained in place <br />during the grading a.id filling process. The disturbed yard <br />area shall be seeded or sodded immediately after grading is <br />completed. <br />6. Authorities granted by this resolution run with the <br />property not with the applicant, but are permissive only and <br />must be exercised by application for a land alteration <br />permit within one year of the date of Council approval, or <br />the special conditions of this resolution will expire on <br />that date (June 12, 1990). <br />7. Violation of or non-compliance with any of the terms and <br />conditions of this resolution shall constitute a violation <br />of the zoning code, shall automatically terminate any <br />authority granted herein, and shall be punishable as .. <br />misdemeanor. <br />8. The undersigned applicant has read, understood and <br />hereby agrees to the terms of this resolution and on behalf <br />of himself, his heirs, successors and assigns, hereby agrees <br />to the recording of this esolution in the chain of title of <br />the property. <br />Page 3 of 5 <br />
