City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING � <br />A VARIANCE TO <br />MUNICIPAL EONINC 4 1 l/ J <br />SECTION 10.22, SUBDIVISIONS 1 i 2 AND <br />SECTION 10.55, SL:BDIVISION 8, AND <br />GRANTING A CONDITIONAL USE PERMIT PER <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #1391 <br />WHEREAS, Terry Sadler (hereinafter "the appli ") is <br />the owner of the property located at 1396 Baldu: Park Ro ithin <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lot 16, Baldur Park, Hennepin County, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, the applicant has made application to the City <br />of Orono to permit construction Df a retaining wall and placement <br />of fill within the 0-75' :akeshore setback zone, requiring a <br />variance to 14unicipal Zoning Coda Sections 10.22 Subdivision 1 <br />and - and 10.55, Subdivision 8, and a conditional use permit per <br />Municipal Zoning Code Section 10.03, Subdivision. 19. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewec; as Zoning File 1391. <br />2. The property is located in the LR-IC Singl( Family <br />Lakeshore Residential Zoning District. <br />a. The Orono Planning Commission reviewed this application <br />on May 15, 1939 and recommended approval of the proposed <br />variances and conditicnal use permit, per the <br />recommendations of the City Engineer; based on the following <br />findings: <br />A) The applicant's proposal included a retaining wall <br />cons-ructed along the lot linis to a point as close as <br />40' to the shoreline, with fill being placed as close <br />as 35' from. the shoreline. The City Engineer <br />recommended that tha wall be no closer than 70' from <br />the shoreline with fill no closer than approximatel <br />45' to the shoreline. <br />Page 1 of 5 <br />
