City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1666 <br />RESOLUTION ORDERING PREPARATION OF A <br />SEWER AND WATER FEASIBILITY REPORT FOR <br />2477 DUNWOODY AVENUE <br />WHEREAS, for the purpose of protecting the public health and <br />safety and for promoting the most general public welfare, the City has <br />adopted Ordinance No. 210, The On -Site Sewage Treatment Code, which <br />ordinance regulates the proper design, location, construction, <br />alteration, use and maintenance of on -site sewage treatment systems, <br />and which ordinance establishesl a program for inspection of existing <br />on -site systems to assure a minimum, adequate level of sewage <br />treatment in the City; and <br />WHEREAS, this inspection program has identified a parcel of <br />property located at 2477 Dunwoody Avenue, PID 20-117-23-22-0015, <br />which property is located within the urban sewer service area of the <br />City and which property contains an inadequately functioning, <br />nonconforming septic system locatedwith,n 15 feet of LakeMinnetonk,;; <br />and <br />WHEREAS, 2477 Dunwoody Avenue is a land -locked parcel of <br />land not abutting any public street or right-of-way; and <br />WHEREAS, a sewer stub is avai lable on Dunwoody Avenue, which <br />service has not been extended to the actual property line of this <br />property; and <br />WHEREAS, this property has been assessed for sewer trunk <br />availability but has never been assessed for sewer unit or sewer <br />lateral service; and <br />WHEREAS, all adjacent properties do directly abut Dunwoody <br />Avenue, are already connected to municipal sanitary sewer and were <br />assessed for sewer trunk, unit and lateral charges; and <br />WHEREAS, a water main stub assigned for this property is <br />available on Dunwoody Avenue and this property has been assessed for <br />municipal water service availability; and <br />WHEREAS, it is proposed to extend sanitary sewer and <br />municipal water service stubs from Dunwoody Avenue to the actual <br />property line of this subject property and to assess said property for <br />all or a portion of the improvement pursuant to Minnesota Statutes <br />Chapter 429. <br />
