city of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />ORDERING PREPARATION OF PLANS AND <br />SPECIFICATION FOR PAUL SMITH SANITARY <br />SEWER AND WATERMAIN EXTENSION AT <br />2477 DUNWOODY AVENUE <br />WHEREAS, on September 14, 1981, the City Council adopted <br />Resolution 1312 ordering preparation of a feasibility report regarding <br />proposed sanitary sewer and municipal watermain extensions to serve the <br />Paul Smith property at 2477 Dunwoody Avenue, P.I.D. 20-117-23 22 0015; <br />and <br />WHEREAS, on January 11, 1982, the City Council adopted <br />Resolution 1348 accepting the feasibility report and calling for a <br />public hearing on such improvement; and <br />WHEREAS, on March 22, 1982, the City Council amended Resolution <br />1348 by delaying the scheduled hearing date in accordance with a request <br />made by Paul Smith, the only property owner proposed to be benefitted by <br />or assessed for the subject improvement; and <br />WHEREAS, direct mailed notice to all affected property owners <br />and ten days published notice of the hearing through two weekly <br />publications of the required notice was given, and the hearing was held <br />thereon on the 14th day of June, 1982, at which time all persons <br />desiring to be heard were given an opportunity to be heard thereon; and <br />WHEREAS, the lot for which sewer and water service is proposed <br />is located within. the Urban Sewer Service Area of the City of Orono, <br />but it has never previously been assessed for sewer lateral service <br />because it is a landlocked parcel not abutting any public street or <br />right-of-way, and because the available sewer service stub was not <br />previously extended from the public right-of-way to the boundaries of <br />this parcel. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the <br />City of Orono, pursuant to Chapter 429 of Minnesota Statutes, does hereby <br />order Bonestroo, Rosene, Anderlik and Associates, Inc., City Engineers, <br />to prepare plans and specifications for the extension of municipal <br />sanitary sewer and municipal water main service from the existing <br />service stubs located in the right-of-way of Dunwoody Avenue to the <br />Paul Smith property described above. <br />Adopted this day of 1982, by a <br />vote of ayes and _ nays. <br />WiX am B.
