Smith <br />11217 Calvert Street <br />North Hollywood, <br />California 91606 <br />Re: Sewer Connection - 2477 Dunwoody Avenue <br />Dear Mr. Smith: <br />We are in receipt of your letter of November 10, 1979. It is the <br />opinion of the City Engineer, Glenn Cook, that your property can be <br />served by a grinder pump and section of force main attached to a <br />gravity sewer line leading across your neighbor's lot. According <br />to our as -built maps, a sewer stub extends to near your neighbor's <br />property line. (See attached letter from Engineer and sketch.) <br />Your statement that you should not be forced to connect to sewer <br />since it has not been brought to your property is partially correct. <br />The stub is not at your property line, however, it is as close as <br />the City can get without obtaining an easement. In our opinion. <br />you have two choices: 1) you may make the complete installatic. <br />from your house to the street, obtain an easement from your neighbor <br />and incur all costs yourself; or 2) upon your refusal to do this, <br />the City will obtain an easement and install the lateral to your <br />property line assessing you directly for all costs involved including <br />materials, labor, legal, engineerinq and administrative costs. In <br />either case the City will provide you with a pump and tank. From past <br />experience, the cost to you of having the City bring the lateral to <br />your lot will undoubtedly be greater than if you have it done yourself. <br />t suspect that the courts would require the City to extend the lateral <br />to your property, assess you for it, and you would have to connect to <br />it immediately when it became available. It has been our intent thus <br />far to avoid costly legal action if at all possible. However, with <br />only about 15 properties remaining to be connected out of over 1,400 <br />where sewer is available, we would like to finish *ie connections early <br />in 1980. <br />Please let us know as soon as possible as to your plans for connection. <br />The connection must be made!
