Hamm*, (hereinafter "the applicant") is the owner of the <br /> property located at 485 Orono Orchard Road South within the City of Orono(hereinafter"the City") <br /> and legally described as follows: <br /> Exhibit A attached, Hennepin County, Minnesota(hereinafter "property"); and <br /> . WHEREAS,the applicant has applied to the City for a variance to Municipal Zoning � <br /> Code Section 10.03, Subdivision 15 (C)to permit a 7' monument and gate at the driveway entrance <br /> to be constructed within the 50' front yard street setback where a monument and gate of 3 %2 feet is <br /> allowed; and � - <br /> � WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on March 17,2003,at which time all persons desiring to be heard <br /> concerning this application were given the opporlunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#03-2878. � <br /> 2. The property is located in the RR-1B Zoning District, where 2.0 acres is the <br /> minimum required lot area. The property consists of approximately 21+acres. <br /> 3.
