Zoning File #1309 <br />August 11, 1908 <br />Page 3 of 4 <br />Review of Current After -the -Fact Application - <br />The applicant's landscape contractor has attempted to solve the <br />drainage prrJ lems along the south lot line without the benefit of permit <br />review. Re, ^w Exhibits M & N, Staff can see no change in the criginal <br />swale a lon j south lot line that Krutzig had installed. This still <br />remains as a grassed area. As you proceed lakeward, the applicant's <br />contractor has installed a stored pathway leading to a pond that has an <br />underliner of plastic. The pond itself has been constructed with a plastic <br />liner placed within the entire cavity of the pond. Large boulders outline <br />the pond and a raised landscape area has been installed along the south <br />side of the pond with filter fabric under.ining the entire landscape area. <br />In addition, there have been new rock landscape Areas with filter installed <br />fabric adjacent to the boulder wall along the lakeside of the house. <br />Landscaping with filter fabric or plastic was classified its hardcover `)y <br />the City in a recent review by both Council and Planning Commission. In <br />fact, both groups unanimously voted to classify filter fabric as hardcover. <br />As a result, the landscaping adjacent to the boulder wall would bring the <br />property over the allowed 25% hardcover with the 75-250' setback area and <br />in addition, provide hardcover within the 0-75' setback area where none is <br />allowAd. <br />Review Exhibits K & L, Cook's letter and sketch regarding the current <br />proposal. Once again, he calls attention to the need to re -construct the <br />swale along the south side of the house. It should also be noted that the <br />majority of work performed within the lakeshcre yard has been installed <br />within the flood plain of Lake Minnetonka. All work appears to be below <br />the 931.5 elevation. Note the entire deck area and boulders in the <br />lakeshore yard Dave been placed along the line of the 931.5. The 75' <br />setback line seems to be 5-8' west of the 'aou_der wall along the lakeshore <br />of the house. Cook also notes that the pond construction seems tn provide <br />no significant improvement to the quality or quantity of water discharged <br />*o the lake. <br />Staff Recowee ndat ion - <br />Prior to asking the current owner to submit additional information <br />regarding the current proposal, staff feels that it is the City's role to <br />first advise the applicant what improvement would be more consistent with <br />the City's policy regarding work within the lakeshore l,rotected area and <br />flood plain. At this point, staff can recall application that dealt <br />w;th the construction of a pond within the 75' ._:.back area or within the <br />flood plain of Lake Minnetonka. The previous drainage plan called for a <br />swale that would continum and fan out withn thw lakeshore yard based on the <br />final elevation of the Swale along the south sidr_ of the property. Once <br />again, the swalt along the north side seems to be functioning the way it <br />was intended. As the elevations in the lakeshort yard appear to be more <br />graduated and tend to slowly drain to the lake. <br />
