City Council <br />October 18, 1988 <br />Page 2 <br />3) Any error in siting and permitting construction of the <br />Trainor house was not the fault of the Johnsons; <br />4) For the Council now to arbitrarily require a 10-foot <br />setback serves to take property unnecessarily from an <br />innocent landowner, Johnson, who was not responsible <br />for the encroachment; <br />5) Johnson should not be penalized for an error of the <br />Trainors in building, and of the City in issuing <br />permit for the Trainor residence. <br />For all of the above reasons we feel that the Johnson/Eiss <br />proposal for a lot realignment with a 5-foct setback is both <br />reasonable and appropriate, and we ask the Council to overrule <br />the Planning Commission's conclusions and approve a lot <br />realignment with a 5-foot setback. <br />Respectfully submitted, <br />William K.
