The property is located in the LR-1C Zoning District, where 0.5 acres is the <br /> minimum required lot area. The property consists of approsimately 0.27 acres. <br /> 3. The Orono Planning Commission revie�ved this application on March 17, 2003 <br /> and recommended approval by a vote of 5 to 0. <br /> 4. The Planning Commission made the following findings of fact: <br /> A. The original structure has been located within this footprint since 1959; <br /> B. The property is unique in that it has lakeshore on the front and rear and almost <br /> all of the lot falls within the required 75' structure setback from the OHWL; <br /> C. The application does not propose to increase the footprint of the structure, <br /> change the existing setbacks or change the existing hardcover; and <br /> D. Additional vegetative screening alona the lake side of the residence will help <br /> to mitigate the visual impacts of the added height of the structure adjacent to <br /> the lake. <br /> 5. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district;that granting the <br /> variances will not adversely affect traffic conditions,light,air,nor pose a fire hazaxd <br /> or other danger to neighboring property;would not merely serve as a convenience to <br /> the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is <br /> necessary to preserve a substantial property right of the applicant; and would be in <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the <br /> City. <br /> 6. The City Council has considered this application, including the findings and <br /> recommendations of the Planning Commission, reports by City Staff, comments by <br /> the applicant and the effect of the proposed variances on the health, safety and <br /> welfare of the community. <br /> CONCLUSIONS, ORDER, AND CONDITIONS <br /> Based upon one or more of the above findings,the Orono City Council hereby grants variances from <br /> Municipal Zoning Code Section 10.22, Subdivision 2;Section 10.56,Subdivision 16(C)(1);Section <br /> 10.2�,Subdivision 6(B); Section 10.22, Subdivision 1(B);and Section 10.56,Subdivision 16(C)(6) <br /> Page 2 of 5 <br />
