A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6 (B) <br />FILE #1341 <br />WHEREAS, Todd Ziesmer (hereinafter "the applicant") has an <br />interest in the property located at 3440 Bayside Road within the City of <br />Orono (hereinatter "City") and legally described a, follows: <br />Exhibit A, attached (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to <br />Municipal Zoning Code Section 10.23, Subdivision 6 (B) to permit the <br />construction of a single family residence on a ' of of 118' in wid`_h where a <br />200' lot width is normally required for construction of a single family <br />residence. <br />NOW, THEREFORE, BE IT RESOLVES by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1341. <br />2. The property is located in the LR-lA Single Family Lakeshore <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on October <br />3, 1988 and recommended approval. of the proposed variance based upon <br />the following findings: <br />A) A residence previously existed on the property and was only <br />recently removed due to its poor condition. <br />B) The property is 2.35 acres in area. <br />C) The pro�;osed residence meets the required 30' side setbacks <br />and greatly exceeds the regt•4 -ed 50' minimum front setback for <br />construction of a single famil; residence in the Ll:-lA zone. <br />D) Applicant has provided septic testing to verify that i <br />primary and alternate drainfield site can be developed within the <br />property boundaries. <br />Page 1 of 4 <br />
