Sewer to be provided either through <br />Long Lake by the Joint Powers Agreement or by constructing a new <br />interceptor along the Highway 12 corridor. <br />4. The rezoning will allow single family residential development. <br />5. The property is immediately adjacent to a commercial corridor <br />along Highway 12 and the proposed 1 acre zoning would provide an <br />excellent buffer to the surrounding rural residential districts. <br />G. The Comprehensive Plan Amendment included this property within the <br />hi,JSA district and approved Municipal services for the area. <br />7. The current code will require rezoning to R-lA in order to allow <br />the 1 a^re densities recommended in the Comprehensive Plan Amendment. <br />The issue of sewer remains unresolved at this point, but the City <br />Engineer confirms that there are available alternatives for servicing the <br />property with sewer. The question remains how the property will be <br />serviced by sewer either via the Long Lake system or the extension of <br />Orono's Municipal sewer lines. The owner is aware of his obligation to <br />pay for any extension of Municipal sewer to the property. <br />Planning Commission Recommendation - <br />The Planning Commission approved the rezoning of the northern portion <br />of this property from RR-lB to R-lA based on one or more of the findings <br />noted above in the staff memo. The minority opinion denied the rezoning <br />based on the precedent setting aspect stating that they were fearful that <br />the surrounding rural areas would request the same kind of rezoning. The <br />surrounding rural residential properties were not included within this <br />Comprehensive Plan Amendment and as a result were not included within the <br />newly aligned MliSA district. There can be no rezoning from RR-1B to R-lA <br />wit- ut sewer. In order to allow the rezoning to a greater density, the <br />City would have to initiate a new Comprehensive Plan Amendment. The <br />en iosed resolution has been drafted approving the rezoning as requested by <br />the applicant authorizing staff to prepare the necessary ordinance amend- <br />ment for formal action by the Council upon final resolve of the extension <br />of sewer to the property. <br />
