A RESOL. £JN GRANTING <br />A VARIANCE AND COMPITIONAL USE PERMIT <br />PER MUNICIPAL 70NTNG CODE <br />SECTION 16.03, SUBDIVISIONS 19 & 20 AND <br />SECTION 10.55, SUBDIVISI 8 <br />FILE #1324 <br />WHEREAS, Mr. & Mrs. William Gregory (hereinafter "the <br />applicants") are the owners of the property located at 1099 Tamarack Drive <br />within the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lot 2, Block 1, Underhill Farms, Hennepin County, Minnesota <br />(hereinafter "property"); and <br />WHEREAS, the applicants have made application to the City of <br />Orono to permit the excavation of a Fond within a designated wetland area, <br />requiring variances and conditional use permit per Municipal Zoning Code <br />Section 10.55, Subdivision 8 and Section 10.03, Subdivisions 19 & 20. <br />NOW, THEREPORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1324. <br />2. The property is located in the RR-lB Single Family Rural <br />Residential Zoninq District. <br />3. The property is approximately 3.5 acres in total area. <br />4. The Orono Planning Commission reviewed this application on <br />September 19, 1988 and recommended approval of the proposed variance <br />and conditional use permit based on the following findings: <br />A) The wetland area to be excavated is a designated wetland of <br />0.6 acres per City Wetland Maps. <br />B) Approximately 25% of the wetland area is intended +.o be <br />excavated to create a pond approximately 120' in lenqth and 60' <br />in width. The spoils will be placed along the east and south <br />sides of the driveway which exists to the north and west <br />boundaries of the wetland. <br />Page 1 of 4 <br />
