Box 66 <br />Crystal Bay , MN 55323-0066 <br />Your application for a permit to build a detached garage at 1449 Bay Ridge Road is denied based on Planning <br />Director Mike Gaffron's finding that the proposed garage would have a negative impact on neighboring <br />properties because the yards adjacent to Bay Ridge Road are maintained as formal front yards. Unless the <br />proposed garage were placed close enough to the principal structure that it appeared to be attached to the house <br />it would be out of character with the rest of the Bay Ridge Road neighborhood. Also , the proposed location <br />does not satisfy the 30-foot side setback requirement. <br />The specific code sections are : <br />1. 78-1, Definitions: Through lot means a lot which has a pair of opposite lot lines abutting two <br />substantially parallel streets, and which is not a corner lot. On a through lot, both street lines shall be <br />front lot lines for applying this chapter. <br />2. 78-1431 : Accessory buildings and structures on through lots , specifies that all accessory buildings and <br />structures on through lots located in R districts shall meet the following requirements : <br />(1) The building or structure shall meet the principal building setbacks that are established <br />under sections ... 78-305 .... <br />(2) No negative impacts to adjacent neighbors or public right-of-way result in the placement of <br />the building or structure, determined at the discretion of the planning director. <br />Should the planning director determine that item (2) above cannot be met an accessory structure or <br />building may be permitted by conditional use permit if the planning commission determines no negative <br />impacts result in the placement of the building or structure.
