CITY of ORONO; <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ~. t~ 9 $ <br />in excess of 500 cubic yards of fill to be brought onto subject property for the purpose of <br />constructing a berm along the northern border along North shore Drive. Appro v al is subject <br />to the following conditions: <br />1. Council approval is based on the site plan submitted by the applicants attached to this <br />resolution as Exhibit A. Any amendments to the site plan may require further <br />Planning Commission and City Council review. <br />2. The applicants must obtain a land alteration permit from the City prior to hauling <br />fill to the site. <br />3. The applicants must obtain a Minnehaha Creek District ·watershed District <br />erosion control permit prior to commencing the project. <br />4. Silt fence shall be in place prior to fill or grading activities. Applicants and their <br />contractors shall follow the "Best Management Practices for Protection of Water <br />Quality in Urban Areas." <br />5 . A route map shall be provided to the City prior to the start of construction showing <br />which county/city streets are to be used. <br />6. Berm shall have vegetation re-established immediately upon finished grading. <br />7. Applicants shall be responsible for any necessary public road cleanup immediately <br />upon City request should the need arise due to hauling activity. <br />8. Authorities granted by this resolution run with the property not with the applicants, <br />but are permissive only and must be exercised by application for a land alteration <br />permit within one year of the date of Council approval or the special conditions of this <br />resolution will expire on that date (November 25, 2003). <br />9. Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically terminate <br />any authority granted herein, and shall be punishable as a misdemeanor. <br />10 .
