(15%) is permitted; 6,442 s.f. (57.08%) of hardcover where <br /> 2,821.5 s.f. (25%) is permitted in the 75'-250' hardcover zone; and a 21' encroachment into the <br /> average lakeshore setback. Approval is subject to the following conditions: . <br /> 1. Council approval is based on the site plan submitted by the applicant attached to this <br /> resolution as Exhibit A. Any further amendments to the site plan may require further <br /> Planning Commission and City Council review. <br /> 2. Approval is subject to the following: ' <br /> a) 1,506 s.f. of existing landscape plastic hardcover must be removed on the � <br /> • property; and <br /> b) in the 0-7�' hardcover zone,the 681 s.f. concrete patio must be removed to <br /> reduce the hardcover from 1,341 s.f. (24.86°.'0)to 660 s.f. (12.23%). : � <br /> 3. Authorities granted by this variance run with the property not�vith the applicants,but . <br /> , aze permissive only and must be exercised by application for a building permit within � <br /> one year of the date of Council approval, or these variances �vill expire on that date <br /> (February 24,2004). <br /> 4. Violation of or non-compliance with any of the terms and conditions of this variance <br /> shall constitute a violation of the zoning code, shall automatically terminate any <br /> authority granted herein, and shall be punishable as a misdemeanor. <br /> 5.
