City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1609 <br />ppli,ant has agreed to work with the City to reduce the amount - <br />of surface runoff creates by the excessive hardcover. <br />F. The City Council has considered this application including the <br />findings and recommendations the Planning Commission, reports by <br />City staff and consultants, ro • 2nts and reports of applicant and the <br />of f.ect of the propose; location and use of the proposed addition on the <br />health, safety and welfare of the community. <br />7. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district: that granting the variances would <br />not adversely effect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the owner, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a <br />substantial property right of the owner; and would be in keeping with <br />ti.e spirit and intent of the Zoning Code and Comprehensive Plan of the <br />City and in addition makes the following specific findings: <br />a) the property is located within 500 feet of Lake Minnetonka and <br />subject to the restrictive environmental standards that govern the <br />use and development of lakeshore property within the City. <br />b) in granting a parking variance of 24 stalls, the applicant has <br />reduced the hardcover by 26%. <br />8. Vic City Counci 1 finds that granting a Conditional Use Permit to <br />allow the expansion of the church structure on the property will not be <br />detrimental to the health, safety or general welfare of the public, <br />would not adversely affect light, air no pose a fire hazard or other <br />danger to neighboring properties, nor will this use depreciate <br />surrounding property values and the proposed level of use of the <br />property will be in keeping with the intent and objectives of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby grants a <br />Conditional Use Permit and hardcover variance and required parking <br />variance to the Calvary Memorial Church to permit the construction of an 8l' <br />X 104' sanctuary addition to the existing church structure subject to the <br />following conditions: <br />1. Applicant enters into an agreement with the City to provide for <br />annual inspection of the retention pond and outlet structure to <br />assurc adequate maintenance of the proposed system. The City will <br />require a performance test prior to acceptance and approval by the <br />City of the surface water maintenance system. <br />-2- <br />
