I. <br />5107SI; <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1878 <br />A RESOLUTION GRANTING VARIANCES TO MUNICIPAL <br />ZONING CODE SECTIONS 10.22 SUBDIVISIONS 1 i 2 <br />AND 10.25 SUBDIVISION 6(B) - FILE 1977 <br />WHEREAS, James Ilerner (hereinafter "the applicant" )isowner <br />of the property located at 1408 Baldur Park Road within the City of <br />Orono (hereinafter "City") and legally described as follows: <br />Lot 13, Block 1, Baldur Park (hereinafter "the property"); <br />a❑d <br />WHEREAS, the applicant has applied to the City for a variance <br />to Municipal Zoning Code Section 10.22, Subdivision 1 to permit the <br />construction of additions to an existing house, which additions <br />encroach approximately 5' into the average lakeshore setback area; and <br />a var _ance to Section 10.22 Subdivision 2 to permit hardcover in excess <br />of the 25% hardcover allowed in the 75-250' lakeshore setback zone; and <br />a var:ance to Section 10.25 Subdivision 6B to allow a side setback of <br />5.7 feet where a 'U' set4,ack is normally required. <br />NOW, THEREFORE BE IT RESOLVED by the City Counci 1 of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as zoning file #977 <br />2. The property is located in the LR-1C Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planni.ng Commission reviewed this application <br />on October 21, 1985, and recommended approval of the proposed <br />variance based upon the following findin:ls: <br />a) The property is 12, UC,0 s. f . in area or 0.28 acre and <br />(,ont.ains ar existing clarage and house. No other land is <br />available to increase the area of the property. <br />b) Theproposed additions will cover158 s.f. additional <br />area that is not currently hardcover. <br />c) Substantial art -as of decarative rocks underl.iin by <br />plastic exist on the property that can he made non - <br />hardcover, so that there is capability to have no net <br />increase in ;iardeover as a result of the additions. <br />Page 1 of 4 <br />
