1 (3) the proposed acquisition is consistent with the <br />2 approved master plan maintained by the metropolitan council; and <br />(4) the district is able to carry out the plan and operate <br />4 the <br />regional <br />park. <br />5 The <br />findings <br />required by this subdivision may have been made <br />6 before or may be made on or after the effective date of this act. <br />7 Subd. 4. (SMALL HOMESTEAD LIFE ESTATE.) The park district <br />8 may not acquire the fee title to a homestead of less than_20 <br />9 acres by eminent domain without the written consent of the <br />10 owner, but the district may acquire all title to the property <br />11 except for a life estate in the person or Fersom. residing on <br />12 the homestead. <br />13 Subd. S. (EXPIRATION. Authority to acquire real property <br />14 through eminent domain as provided in subdivisions 2 and 3 <br />15 exoires on December 31, 1989, except that an acquisition <br />16 approved by the metropolitan, council before January 1, 1990, may <br />17 continue. <br />18 Subd. 6. [APPLICATION.] This section applies in the <br />19 counties of Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and <br />20 Washington. <br />8 Sec. 84. (EFFECTIVE DATE.) <br />9 This article is effective the day following final <br />10 enactment, except that the fee increases provided in section 55 <br />11 are effective May 1, 1988; section 26 is effective October 1, <br />12 1988; and section 56 Is effective January 1, 1989. Section 47 <br />13 is effective July 1, 1989. <br />14 Sections-40 to 42 are effective January 1, 1989, and apply <br />15 to amounts checked off on income tax returns filed on and after <br />16 that date. <br />
