Mina.99fa 36323.afvaidpei Of ffm <br />. e e On the North Shore of Lake Minnetonka <br />September 15, 1988 <br />Mr. Vern Genzlinger <br />Assistant County Administrator <br />Hennepin County <br />2488 Government Center <br />Minneapolis, MN 55487 <br />Re: Hennepin County Maintenance Station - 3888 Shoreline Drive <br />Dear Vern, <br />This letter is written in response to the proposed ordinance <br />change In which Hennepin County has designated the above <br />referenced facility, together with all its other facilities in <br />the County, as a temporary transfer station for the County's <br />Solid Waste Management Ordinance. <br />It is our present understanding that the County's intent for <br />this site is to use it strictly as a weighing point to direct <br />various private haulters to the appropriate off-load site, and <br />not as an actual 'transfer station'. <br />As you may be aware, the zoning on this property in the City <br />of Orono is LR-lC which is a single family residential zoning. <br />while municipal buildings are a permitted use within any of the <br />residential zones in the City, the use as a County maintenance <br />facility however, is neither a permitted nor a conditional use as <br />strictly set forth under the zoning code. <br />we are aware that the zoning of this site was commercial in <br />1962 when the facility was constructed, however, that zoning <br />changed to residential in the early 1978's, hence continued use <br />of the property for your maintenance facility has been considered <br />a nonconforming use since that date. I would note for the record <br />that City files provide no indication that the County applied for <br />a *nonconforming conditional use permit* for continued use of the <br />maintenance facility, although such a permit was required and <br />well publicized at that time.
