Mar 19 07 04:08p Kristi Anderson <br />·it ~ \J e ~ \ A <br />City of Orono <br />Planning Commission <br />March 17, 2007 <br />Dear Commissioners, <br />952-471-0608 <br />As the City of Orono's Recorder for the past 5 years, only to have left last summer, 1 am <br />aware of the various City Codes and Ordinances, with regard to new construction, as well <br />as, the risks that accompany precedent setting actions. <br />As the adjacent property owners of 1408 Baldur Park Road, it is our concern that the <br />proposed new construction for 1404 Baldur Pk Rd will cause us undue hardship with <br />regard to additional water and drainage. <br />As you may be aware, we are already at/below floodplain and cannot accommodate <br />additional runoff or water on our property. (We have photos for exhibit) It is a concern <br />that allowing hardcover in excess of 48% and the mass that accompanies it, will have <br />detrimental effects on our property -not only are these hardcover figures well over the <br />allotted 25% , more realistically they are even in excess of the precedent set within this <br />neigl:lborhood of 30-44%. In addition, the height only accentuates the massing which <br />concerns us as well. I support many past Planning Commissioners rationale that small <br />lots do not a hardship make-in fact, past Mayor Jabbour has commented many times · <br />small lots, small houses. <br />_I have examined the plans and am impressed with the attempts to minimize some impacts <br />with regard to structural cover and side setbacks, but want to ensure that our rights as <br />adjacent property owners are not adversely impacted -Causing us thousands of dollars in <br />repairs due to additional water issues. By granting the builder one variance, there is <br />concern that you may have caused us two in return, and thrust a hardship situation upon <br />us. <br />I am aware that a true definition for a 2 ½ story is somewhat loosely defined and has not <br />been pinned down, but also question where the 30' height limitation comes into play, as <br />this home clearly exceeds this without a hardship to support additional height. <br />Sincerely, <br />Kristi and Bill Anderson <br />1408 Baldur Pk Rd <br />Wayzata.
