MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, May 14, 2007 <br />7:00 o'clock p.m. <br />(#07-3266 Vogue ICF Homes, Continued) <br />Curtis stated the house is approximately 12 feet from the 75 foot line. <br />Hahn stated the house is located three feet further back than what is required by code. <br />Reid stated he would like to see the house pushed further back. <br />Bremer noted Mr. Reid's view would not be impacted by this house and that the structure has to be <br />located behind the average setback line. <br />Murphy stated this is a situation where there is an empty lot and that there should be some way to <br />incorporate the comments of the City Council regarding the height and the drainage into the plans. <br />Murphy commented he does not have complete confidence in the builder and that there needs to be more <br />concise answers to the concerns raised by Staff and the Council. Murphy stated he is inclined to deny the <br />application and require the house be redesigned. <br />Bremer stated she is not supportive of denying the application but that the plans should be revised. <br />Bremer stated the applicant needs to address the height of the structure, the hardcover, and the drainage. <br />Bremer moved, Murphy seconded, to table Application #07-3266, Vogue ICF Homes/Benjamin & <br />Karen Milbrath, 1404 Baldor Park Road, to allow the applicant time to revise his plans. <br />JeffUklu, 1416 Baldur Park Road, stated he has resided in this area for 30 plus years and that he rebuilt <br />his home in 1986. The lots in this area are 50 foot lots and that his understanding is that the laws of the <br />City should be consistently applied, which is not always the case. Uklu stated there are a number of <br />houses that have been constructed that exceed the City's 30-foot height limit. A major issue in this <br />neighborhood is water management and constructing homes that are out of proportion with the <br />neighboring structures. Uklu challenged the City Council to enforce their policies and codes consistently. <br />Betsy Nusbaum, 3480 North Shore Drive, thanked the Council for taking into consideration the drainage <br />problems being experienced in this area. Nusbaum inquired what direction the Council is giving to the <br />applicant. <br />White stated the applicant would need to work with Staff and that the Council is not able to at this time <br />give detailed directions on what should be built on this lot. <br />Kristie Anderson, 1408 Baldur Park Road, thanked the Council for taking the concerns of the neighbors <br />into consideration on this application and that she is aware the City has required on numerous occasions <br />that the size of the house be reduced based on the small lot size. <br />Murphy commented the Planning Commission and City Council spend a great deal of time on each <br />application and attempt to apply the City's regulations as consistently as possible. Murphy stated there <br />are a number of builders that try to maximize the lots and attempt to find ways to get around the City's <br />rules. <br />Turner noted Mr. Vogstrom is on vacation and not able to attend tonight's meeting. <br />VOTE: Ayes5,Nays0. <br />PAGE16
