The house at 3490 North Shore Drive is three stories but has a defined height of 30 feet. <br />Without the windows in the gable end the defined height of the proposed house would be 29.6 feet. <br />Under the proposed zoning code changes to better regulate building mass the windows would be <br />disregarded in calculating building height, but the 38 foot peak height would be six inches in excess of <br />the proposed maximum peak height for a 50 foot wide lot. <br />The grading plan has been revised since it was reviewed by the Planning Commission but is still not <br />acceptable to the City Engineer. The City Engineer recommends the Applicant work with the adjacent <br />property owners. The Applicant and the property owners to the east (the Andersonsons) are willing to <br />work together but haven't been able to meet and work out the details. The Applicant is willing to <br />work with the property owner to the west (Charles Reid) if that property owner wishes. It's a difficult <br />task because at its highest point the property is only about 2.5 feet above lake level, the lots on either <br />side are no higher, and, because of limits on fill, the street yard must be below street level which <br />means that all drainage must go north around the houses. <br />COUNCIL ACTION REQUESTED <br />Direct Staff to draft a resolution: <br />A. Granting the requested <br />a. lot width variance, <br />b. lot area variance, <br />c. grade adjacent to structure variance, and <br />d. hardcover in the south 0 to 7 5 foot zone variances as requested; <br />B. Granting a hardcover variance for the 75 to 250 foot zone to the extent the Council determines <br />appropriate; and <br />C. Taking the action Council determines appropriate regarding the height variance <br />for Council consideration once the grading plans has been revised to the satisfaction of the City <br />Engineer.
