Stephens III and Nancy Stephens, husband and <br /> wife, (hereinafter "the applicants") are the owners of the property located at 350 <br /> Crestview Avenue within the City of Orono (hereinafter the "City") and legally described <br /> as follows: <br /> N <br /> Lot 6, 7, and 8/and that part of Lot 5. lock 6 BAYSIDE ADDITION TO LAKE <br /> MINNETONKAf/'lying south of the north 40 feet thereof. <br /> (hereinafter the "property"); and <br /> WHEREAS, the applicants have made application to the City of Orono <br /> for variances to Orono Municipal Zoning Code Section 78-282, 78-305 (B), and 78-1288 <br /> (B) to allow construction of a new residence on a property that is 0.455 acres in size <br /> when 2 acres is normally required and for the structure to be setback 30' from the front <br /> property line when 50' is required, 10' from the side property line when 30' is required <br /> and, 30' from the rear property line when 50' is required and also to allow 45% <br /> I. xdcover in the 75-250' zone when 25% is normally allowed. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of <br /> Orono, Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#03-2917. <br /> 2. The property is located in the LR— IA, One Family Lakeshore Residential <br /> Zoning District, which requires a minimum lot size of 2 acres. The <br /> subject property is 0.455 acres in size. <br /> 3. The Planning Commission reviewed this application at a public hearing <br /> held on August 18, 2003 and November 17, 2003 and recommended <br /> Metro legal Services Inc. <br /> Page 1 of 6 Box 491 <br />
