The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district: that granting the variances <br />\otOUld not adversely effP.ct traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the owner, but is necessary to <br />alleviate a demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the owner; and would be <br />in keeping with the spirit and intent of the zoning code and <br />comprehensive plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Counci 1 hereby grants <br />variances to Section 34.552 to permit construction of a principal <br />residence on a property that consists of 12,87~ square feet instead of <br />the required 21,780 and has 50 feet of lot width instead of the required <br />100 feet subject to the following conditions: <br />1. All improvements on the site (this includes decks, patios, <br />driveways, hard surfaced walkways, etc.) shall be limited to <br />2,280 square feet of hardcover. <br />2. No structure { includes decks And patios) may not be located <br />closer than 75 feet from the lakeshore and the principal <br />structure must meet the average lakeshore setback of houses on <br />adjacent lots. <br />3. Applicant to quit claim deed portion of Baldur Park Road that <br />intersects the property, area to be deeded must include an <br />additional 3 feet for maintenance. <br />4. No other variances are granted or will b~ permitted in the <br />future for this structure or for the rroperty. <br />5. 1>.uthorities granted by this variance run with the property <br />not with the owner, but .1re permissive only r \d must be exercised <br />by application for a building permitwithinoneyearofthedateof <br />Council approval, or this variance will expire on that date <br />(September 12, 1984). <br />6. Violation of or no~cumpliance with any of the terms and <br />conditions of this Vl'lriance !'!hall constitute a viol.'ltion of the <br />zoning code, sh11l l automatically terminate nny authorityqranted <br />herein, ~n~ shRll be purlshable as a misdemeanor.
