A RESOLUTION APPROVING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 (B), AND <br />SECTION 10.56, SUBDIVISION 16(L)(2) <br />FILE NO* 01-2669 <br />WHEREAS, Richard J. Wett and Marge A. Wett, husband and wife, (hereinafter <br />"the applicants") are the owners of the property located at 1396 Baldur Park Road within the City <br />of Orono (hereinafter "the City") and legally described as follows: <br />Lot 16, Baldur Park, Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for an after the fact variance to <br />Municipal Zoning Code Section 10.22, Subdivision 1 (B) and Section 10.56, Subdivision 16 (L)(2) <br />to allow 3,555.83 s.f. (36.3%) hardcover in the 75-250' setback area where 3,555.83 s.f. (36.3%) <br />exists and 2,452 s.f. (25%) is allowed to permit construction of a four foot overhang over an existing <br />sidewalk on the street side of the residence. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on April 16, 2001, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #01-2669. <br />2. This property is located in the LR-1 C Zoning District, where .5 acre or 21,780 s.f. is <br />the minimum lot area. The property consists of approximately .31 acres or 13,670 <br />s.f . <br />3. The Orono Planning Commission reviewed this application on April 16, 2001 and <br />recommended approval by a vote of 5 to 0. <br />Page 1 of 5 <br />
