The Planning Commission reviewed tis application at a public hearing
held on October 20, 2003 and recormended approval of the average
lakeshore setback and lot area variances based on the following findings: .
a. The lot is situated on a pointzhich causes the entire lot to sit in front
of the average lakeshore setback.
b. The lot is a legal lot of record and ias granted legal buildable status in
1983 as Record Lot ti'o. 13. The lot is 2.9 acres in size located in a 5
acre zoning district.
c. A structure has existed on the lot in the past.
d. A structure could not be constructed on the lot without an average
lakeshore setback and lot area•ariance.
• e. A structure can be built on the lot meeting all other pertinent code
requirements.
4. The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the agplicants and the puDlic, and the effect of the proposed
variance on the health, safety andrelfare of the community.
5. The City Council finds that the conditions existing on this property are
peculiar to it and do not apply generally to other property in this zoning•
district; that granting the variance z-ould not adversely affect traffic
conditions, light, air nor pose a fire haz3rd or other danger to neighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviate a demonstrable hrdship or difficulty; is necessary to
preserve a substantial property riQht of the applicants; and «-ould be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
•
