0 &o� .14 <br />5030516 <br />City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />CITY NO. 1814 <br />OF <br />ORONO TRANSFER EN 7 E2ED <br />DEPT Of iR^f k., r 1.1t S PUBIIG 9EfAl10: <br />A RESOLUTION GRANTING SEP 10 7985 <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE ME"MPN OOUNn MINN. <br />SECTION 10.22, SUBDIVISION 1 i 2 <br />AND SECTION 10.25, IVISION 6 (B) <br />PILE 1993 <br />WHEREAS, John & Susan Purdy (hereinafter "the applicant") <br />are owners of the property located at 1975 Fagerness Point Road within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Lot 5, Fagerness, Hennepin County, Minnesota (hereinafter <br />"property*); and <br />WHEREAS, the applicant has applied to the City for variances <br />to Municipal Zoning Code Sections 10.22, Subdivision 1 t 2 and 10.25, <br />Subdivision 6 (B) to permit the construction of additions to the <br />existing house and garage which will increase hardcover in the 75-250' <br />lakeshore setback z.)ne so that the total amount of hardcover on the <br />lot would exceed the amount of hardcover allowed by the Municipal <br />Zoning Code; and which additions will increase the amount of structure <br />in the 0-75' setback zone where no structure is allowed; and which <br />additions will encroach into the average lakeshore setback zone where <br />no encroachment is allowed; and which garage addition will be located <br />8.5 feet from the side property line where a 10 foot setback is <br />normally required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning % le 0943. <br />Z. The property is located in the LR-IC Single Family Lakcshnre <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application on <br />July 15, 1985, and recommended approval of the proposed variances <br />based upon the following findings: <br />A) The hardships to the property are the slopes and con- <br />figuration or the lot, the location of the existing struc- <br />tures, and the fact that there is lakeshore on two sides of <br />the property. <br />Pnge 1 of 6 <br />j <br />i <br />x <br />3 <br />3 <br />
