ORDINANCE NO. 905 <br />AN ORDINAN-.E RECUTATING THE USE OF ALCOHOLIC BEVERAGES AND <br />CONTROLLED SUBSTANCES AT OPEN HOUSE PARTIES; <br />PROVIDING DEFINITIONS: AND PRESCRIBING A PENALU <br />THE CITY COUNCIL OF THE CITY OF EDINA, MINNESOTA, ORDAINS: <br />Section 1. Definitions <br />"Adult" means any person eighteen (18) years of age or older. <br />"Alcoholic Beverage" means any beverage containing more than one-half of 1% <br />of alcohol by weight. <br />"Minor" means a person not legally permitted by reason of age to possess <br />alcoholic beverages pursuant to Edina City Ordinances and Minnesota State <br />Statutes. <br />"Residence" or "premises" means a home, apartment, condominium, premises or <br />other dwelling unit or meeting room or hall, whether occupied on a temporary <br />basis or permanent basis, whether occupied as a dwelling or for a social <br />function, owned, rented, leased or under the control of any person or persons <br />including the curtilage of such residence or premises. <br />"Open House Partv" means a social gathering of persons at a residence or <br />premises, other than the owners thereof, or those with rights of possession, <br />or their immediate family members. <br />"Controlled Substance" means any drug, agent or substances or defined by <br />Minnesota State Statutes. <br />"Control" means the right of possession of a residence or premises. <br />Sec. 2. Acts Prohibited. No adult having control of any residence or <br />premises shall allow an open house party to take place at the residence or <br />premises if any alcoholic beverage or controlled substance is possessed or <br />consumed at the open house party by any minor, where the adult knew or reasonably <br />should have known that any alcoholic beverage or controlled substance was the <br />possession of or being consumed by such minor at the open house party, an, e e <br />the adult failed to take reasonable steps to prevent the possession or consumN�.ion <br />of the alcoholic beverage or controlled substance by such minor at the open Douse <br />party. <br />Sec. 3. Penalty. Any person violating this ordinance: shall be guilt,., of a <br />misdemeanor and subject to the penalties set forth in Ordinance No. 175. <br />Sec. 4.
