Adherence to the "25% of 75-250' zone" limitation would not allow for <br />construction of the residence as proposed unless the residence was <br />significantly reduced in size. The topography of the site including the <br />unique elevated nature of the property in relation to its surroundings, and <br />the location and orientation of adjacent homes, are factors which support <br />the proposed house location, necessitating a minimum level of hardcover <br />in excess of the normal allowance. <br />g. The overall hardcover reduction on this property from 7,258 s.f. to 5,725 <br />s.f. is a positive step in n:ieeting the long term environmental goals of the <br />City, as is the elimination of pre-existing structures from the north and <br />south 0-7 5' zones. <br />h. The proposed residence will be located to meet all of the required <br />setbacks of the LR-IC District. <br />1. A variance and CUP for grading within the 0-75' lakeshore protected <br />zones is necessary to allow for removal of the existing structures and <br />driveways and to accommodate new structures and driveways. Filling in <br />the northerly 0-75' zone is necessary so that applicant can fill in the <br />excavation that will remain after the existing house is removed, with a <br />blending in of the grade to match pre-existing contours. Grading of the <br />northerly 0-75' zone to create a walkout situation as originally proposed <br />by applicant would not be appropriate and would not be consistent with <br />the City's goals and policies for lakeshore development. Grading and <br />filling in the southerly 0-75' zone is necessary to provide a safe and <br />functional driveway to serve the new residence. <br />4. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance and CUP on the health, <br />safety and welfare of the community. <br />Page 3 of7
