CITY of ORONO <br />(( ,, ii'-RESOLUTION OF THE CITY COUNCIL <br />NO. -:4 l &_ :r <br />3. The revised plan which eliminates a third garage stall at the upper ievel, <br />incorporates a storage garage below the remaining two stalls, and reduces the <br />footprint of the house in order to allow construction of a patio, is approved <br />subject to a condition that no hardsurface or driveway may be installed to the <br />lower storage area. <br />4. Any significant _changes to the approved house footprint, to the approved grading <br />plan, or other changes which result in a plan that City staff deems to·· be <br />potentially in conflict with the intent of this. approval, shall be subject to <br />·· ·· further Council review. ,!,r <br />5. Site grading within the northerly 0-75' zone with the intent to create a walkout <br />situation shall not be allowed. Erosion protection as .may be required by the <br />Building Inspector shall be maintained at all_ times. <br />6. Authorities granted by this variance run with the property not with the <br />applicants, but are permissive only and must be exercised by obtaining a <br />building permit within one year of the date of Council approval, or this variance <br />will expire on that date (August 24, 1999). <br />7. Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />8. The undersigned applicant has read, understood and hereby agrees to the. terms <br />of this resolution and on behalf of himself, his heirs, · successors and· assigns, <br />hereby agrees to the recording of this resolution in the chain of title of t~e <br />property. <br />Page 4 of 6
