a � r <br />C <br />f <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />3. The Orono Planning Commission reviewed this application on February 23, 2000 <br />and on a vote of 4 to 0 recommended approval of a hardcover variance to allow <br />hardcover on the property in the amount of 5,725 s.£, based upon the following <br />findings: <br />A. The property is located on a peninsula and has two 0-75' setback zones. <br />It is not possible to locate a driveway access to the property without <br />replacing hardcover for the new driveway. <br />B. Most vegetation on the site will be protected. One tree within the <br />southerly 0-75' setback will be replaced by additional plantings to be <br />located where the existing detached garage will be removed. <br />C. Overall hardcover on the site will be reduced based on the approved site <br />plan. Total hardcover permitted on the site is 25% of the southern 0-75' <br />Lakeshore setback and the 75-250' setback. <br />D. All hardcover and structure within the northern 0-75' setback will be <br />removed. No new hardcover or structure is proposed to replace any <br />removed in the lakeshore setback. <br />4. The proposed grading in the southern 0-75' Lakeshore setback is required for <br />driveway access. The house plans have been modified to lower the garage to <br />the walkout level requiring a slope of approximately 5% for the new driveway. <br />Less grading is required, thus maintaining a minimal slope and protection of <br />mature trees in the southern 0.75' setback. The first proposal showed a <br />driveway slope of greater than 13%. Additional grading in the northerly 0-75' <br />setback will permit filling in the foundation and restoring the hillside following <br />removal of the existing cabin. Applicant will pull the 940' contour back to <br />accommodate a walkout level. Total grading for the walkout in the northerly 0- <br />75' is 7.4 cubic yards. The grading is necessary as the property had been filled <br />prior to the construction of the existing cabin and is artificially high. Pulling <br />the 940' contour back will permit the lowest floor elevation to be dropped <br />approximately 3'. <br />Page 2 of 7 <br />
