\ <br />Date Application Received : 07 /22/14 <br />Subject: 11-3520, Christian & Beth Johnson, 1376 Baldur Park Rd, <br />Renewal of Hardcover Variances <br />Public Hearing <br />Background <br />In 2011, the previous owners were granted hardcover variances in order to relocate the <br />driveway and change the orientation of the doors on the existing garage allowing for access to <br />their garage and home directly from the Baldur Park Road right of way. The current driveway <br />exists over property owned by the property owner to the west. The 2011 approval was <br />extended administratively once and expired in September 2013 and the work was never started. <br />The applicants are new owners of the property. They are requesting renewal of the exact <br />hardcover variances granted in 2011 in order to address a long outstanding issue with access to <br />the property. They have proposed to execute the previous owners' plan to remove the side- <br />load garage doors and move the doors to the south side for an end-load garage. This will allow <br />them to change the driveway so that they do not need to utilize the neighboring property for <br />access . They are requesting to increase hardcover by 79 square feet in the southwest O to 75' <br />zone; reduce hardcover by 31 square feet in the northeast Oto 75' zone; and increase hardcover <br />by 369 square feet in the 75' to 250' zone for a total increase on the property of 307 square <br />feet. <br />A variance to permit 42 .5% total site hardcover where 25% is allowed is requested. <br />Staff finds due to the current access arrangement and the property's proximity to the lake, the <br />practical difficulties identified in the initial approval resolution remain . <br />Issues for Consideration <br />1. Does the Planning Commission find that that the property owner proposes to use the <br />property in a reasonable manner which is not permitted by an official control? <br />2. Does the Planning Commission find that the variances, if granted, will not alter the <br />essential character of the neighborhood? <br />3. Does the Commission find it necessary to impose conditions in order to mitigate the <br />impacts created by the granting of the requested variances? <br />4 . Are there any other issues or concerns with this application? <br />Staff Recommendation <br />Planning Staff recommends approval of the request to renew hardcover variances in order to <br />reorient the existing driveway consistent with Resolution No . 6074.
