MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, August 15, 2011 <br />6:30 o'clock p.m . <br />road. Puzak stated if they can get on the right track now and head for a long-term solution, that should be <br />what is considered. <br />Schoenzeit indicated that would be outside the scope of what the Planning Commission is considering <br />tonight, but that ifhe understands Mr. Puzak's comments tonight, he would like to see the pavement <br />remain. <br />Puzak requested the original Gronberg survey be displayed. There are a number of discrepancies in the <br />survey and it does not show the full extent of the easement. It references a secondary easement, which is <br />incorrect. The secondary easement is valid only over Lots 21 and 22. Puzak stated the Planning <br />Commission is talking about blacktop to be removed inside a landscaped area, which would make the <br />hardcover calculation incorrect <br />Curtis pointed out the area of the landscaping . Curtis stated the arrow is pointing to the extent of the <br />removal , which is on the edge of the proposed new driveway . <br />Puzak indicated that is not correct. The Wingerds are also showing removal of blacktop into his <br />driveway. Puzak stated he is not sure how the Planning Commission can vote on this without a correct <br />survey. <br />Schoenzeit noted the Planning Commission is an advisory body to the City Council and that the applicant <br />must submit a complete and correct survey prior to moving to the City Council. <br />Puzak commented he would hope they would do so . Puzak asked whether everyone is supposed to <br />receive a mailer regarding this application. <br />Curtis stated a postcard is mailed out to the adjoining property owners. <br />Schoenzeit stated the City receives a list from Hennepin County based on tax records. The City then <br />takes that list and mails the notice to the appropriate property owners. <br />Puzak stated he is the landowner of record and he did not receive notice of tonight's hearing. <br />Curtis indicated the notice would have been sent to 440 West Arm Road East, Spring Park, Minnesota, <br />under the name of 1350 Baldur, LLC . <br />Puzak stated according to the list he should have been mailed four of them. <br />Curtis indicated the City would have only mailed one since the duplicates are removed . <br />Puzak stated he would like to see an affidavit of mailing since he did not receive any. <br />Curtis noted they do have an affidavit of mailing. <br />Puzak stated he would like to receive future notices. <br />Schoenzeit stated Staff strives to ensure accuracy of the notices and Staff can provide that affidavit to Mr. <br />Puzak. <br />_________________ Page <br />19
