No. 5 0 � `� <br /> A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR <br /> � THE HERITAGE DRIVE SAI�TITARY SEWER EXTENSION PROJECT <br /> Whereas,the property owners on Heritage Drive fiave requested that the City of Orono construct <br /> a sanitary sewer extension project to serve their properties. This project has been completed, and the <br /> project connection fee, which is based on the project costs, has been established at $14,400 per sewer <br /> unit. T'he property owner at 1955 Heritage Drive has requested that the City of Orono assess the project <br /> connection fee over a fifteen-year time period; and <br /> Whereas, the property owner has signed an assessment waiver agreeing to waive any and all <br /> rights to appeal the special assessment, with regard to any procedural or substantive rights, rights to a <br /> public hearing, rights to any notices under Minnesota Chapter 429 or any ordinances of the city, and the <br /> constitutions or laws of the State of Minnesota or the United States; and <br /> `Vhereas, the City hereby authorizes and directs the Hennepin County Auditor to levy the <br /> � assessment over a fifteen-year time period at a 6.25% interest rate. Such assessment shall be payable in <br /> • equal annual installments extending over a period of fifteen years, the first of the installments to be <br /> payable on or before the first Monday in January 2004 and shall bear interest at the rate of 6.25% per <br /> annum from the date of the adoption of this assessment resolution. To the first installment shall be added <br /> interest on the entire assessment from the date of this resolution until December 31, 2003. To each <br /> subsequent installment when due shall be added interest for one year on all unpaid installments. � <br /> Therefore, Be It Resolved, that the City Council of the City of Orono, Minnesota hereby <br /> authorizes and directs the County Auditor of Hennepin County to assess the property identified in the <br /> attached assessment roll,made a part hereof, for the amount appearing along with such property,plus <br /> 6.25% interest added as directed.
