The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission,reports by City staff, comments by <br /> the applicants and the public, and the effect of the proposed variance on the health, <br /> safety and welfare of the community. <br /> � 5. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district; that granting the <br /> variances would not adversely affect traffic conditions, light, aix nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants,but is necessary to alleviate a demonstrable hardship <br /> or difficulty; is necessary to preserve a substantial property right of the applicants; <br /> and would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> • 6. The City Council finds that granting a conditional use perinit to allow limited <br /> - plumbing in the accessory structure will not be detrimental to the health, safety or <br /> general welfare of the public, would not adversely affect light, air nor pose a fire <br /> hazard or other danger to neighboring properties, nor will its use depreciate <br /> surrounding property values and that the proposed level of use of the property will <br /> be in keeping with the intent and objectives of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings,the Orono City Council hereby grants <br /> a variance to Orono Municipal Zoning Code Section 10.28 Subdivision SB to allow construction of <br /> a 996 s.f.detached gazage/pool house/storage building,23.1'from the side street lot line where a 50' <br /> side street setback is required; and grants a variance to Section 10.28 Subd. 5(B) to allow the <br /> construction of a 20'x 45'(900 s.f.)in-ground swimming poo115'from the side street lot line where <br /> a 50'side street setback is normally required;and grants a conditional use permit(CUP)per Section <br /> 10.20 Subd. 3Q for plumbing in an accessory building as proposed;but denies a variance to Section <br /> 10.03 Subd.9(C)(2)to allow the new building to be attached to the existing 848 s.f.detached garage; <br /> subject to the following conditions: <br /> 1. The applicants shall establish and maintain year-round vegetative screening along the south <br /> � boundary of the property to reduce the visual impact of the pool and accessory building. <br /> Page 3 of 6 <br />
