The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />16. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety <br />and welfare of the community.· <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivision 1 and Section 10.56, <br />Subdivision 16 (L) (1) to permit 1,675 s.f. (9.8%) hardcover within 75' of the OHWL of the <br />lake where 2,113 s.f. (12.4%) exists and no hardcover is allowed; Section 10.22, Subdivision <br />2 and Section 10.56, Subdivision 16 (L) (2) to permit 2,885 s.f. (63.6%) hardcover where 3,219 <br />s.f. (70.9%) exists and 1,135 s.f. (25%) is allowed; Section 10.25, Subdivision 6 to allow <br />construction on a lot of 0.495 acres where 0.5 acres is required; and Section 10.55, Subdivision <br />8 to permit replacement of structure within 75' of the lakeshore for construction of a new <br />residence on the property subject to the following conditions: <br />1. The existing non-compliant septic system is required to be abandoned per state <br />and local requirements and a new residence shall be connected to sanitary sewer. <br />If it is determined connection to sanitary sewer is not possible additional review <br />of the variances by the Council is required. <br />Page 5 of9
