CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 412 0 <br />G. The proposed structure does not exceed 15% of the lot area. <br />4. The property is located within the Metropolitan Council defined Metropolitan <br />Urban Services Area (MUSA). Only properties within the MUSA are permitted <br />to have sewer connection. <br />5. The Baldur Park peninsula was part of the 1965 LS #1 sewer project. The <br />house is located on Lot 30, Baldur Park about 500' to the existing municipal <br />sewer line in the Baldur Park Road right of way. Completing the connection to <br />the municipal sewer line requires a public utility easement over the adjacent <br />properties to the east. <br />6. All of Lots 21 through 33, Baldur Park were in common ownership at the time <br />sewer was installed in Baldur Park Road. The house located on Lot 30 was <br />required to connect to sewer following final installation of the sewer. <br />7. In 1974 Lots 21 through 29 and Lot 33 were sold separately from Lots 30 and <br />31. Lot 31 was later sold separately. Before Lot 31 was sold separately an <br />easement was granted in benefit of Lot 30 for a private sewage disposal system. <br />8. The existing private sewage disposal system located on Lot 31 for the house on <br />Lot 30 is non-compliant due to the system being located within 75' of the <br />lakeshore of Lake Minnetonka. <br />9. The properties east (Lots 21 through 29 and 31 through 3 3) are under common <br />ownership, although separate ownership from Lot 30. At the October 8, 2001 <br />City Council meeting the property owner of Lots 21 through 29 and 31 through <br />33 has offered to grant a public utility easement to allow connection for Lot 30 <br />to municipal sewer, and a willingness to share in the expense for sewer <br />construction. <br />10. The City of Orono has adopted a sewer policy as part of the 2000-2020 <br />Comprehensive Plan. The sewer policy states the following as it relates to areas <br />in Orono that are within the MUSA: <br />A. The primary method of sewage treatment and disposal within the Urban <br />Area will be municipal sewer. <br />Page 3 of9
