Replatting would be classified as a Class III subdivision due to the extension
of city sewer, dedication of public roadway and request for flexible zoning ( 11.03
subd. 2.66.c.2 throughc.4.).
2.) Minimum public right of way required is 50' (28' pavement width) and
maximum cul de sac length is 1000' (11.33 subd. 4.). Does Baldur Park Road
meet these requirements?
3.) Flood plain (below elevation 931.5) and wetlands shall be dedicated as
conservation easements and not be utilized for computing the area requirements
for any lot (I 1.41 sub. 2 .E and 3.B.4). -
4.) Pursuant to Sec 11.62, prerequisite to approval of a final plat is the dedication
to the public of8% of the land being platted, or equivalent cash contribution be
made by the developer ( e.g. 8% of $1 million= $80,000).
Also, please confirm that Mr. Franklin has not provided a utility easement "free of
charge" as he promised eight months ago at the City Council meeting on October 22,
2001.
Thank you for your clarification of these matters.
Sincerely,
Frederick N.
