#01-2714 -1340 Baldur Park Rd. <br />March 19, 2003 <br />Page3 <br />available, the issue remains as to whether the sewer construction would be a private project <br />involving both Franklin and Puzak, or whether it would be completed and assessed as a public <br />project. <br />Another alternative would be to allow construction of the 5-bedroom home connected to the 3- <br />bedroom septic system, and require that the house be connected to sewer as soon as it becomes <br />available. The obvious risk is that this or a subsequent owner might overuse the system and cause <br />it to fail. <br />The variances granted on November 13, 2001 expired on November 13, 2002 because no permit was <br />applied for nor obtained before the expiration date. The City notified applicant twice in writing of <br />the expiration date and the need to sign the resolution copies to validate them before building permits <br />could be issued. Applicant never signed the resolutions. From staffs perspective, despite <br />applicant's ongoing discussions with Paul Weinberger, the variances have technically expired and <br />a new application must be processed. <br />COUNCIL ACTION REQUESTED <br />Provide direction to applicant and staff regarding the following: <br />1. Should applicant be allowed to construct a new home without connection to municipal <br />sewer? y l-SS <br />2. If so, should the house be reduced in size from 5-bedrooms to 3-bedrooms to match the <br />design capacity of the septic system? 3 t{ t:> <br />3.
