This application was reviewed as Zoning File#03-2933. <br /> 2. The property is located in the LR— 1B which requires a minimum lot area <br /> of 1 acre where the subject property is 2.356 acres. <br /> , 3. The Planning Commission reviewed this application at a public hearing � <br /> held on August 18, 2003 and recommended approval of the conditional <br /> use permits and variances based on the following findings: � <br /> a. The conditional use permit for the non-rental guest apartment meets all <br /> requirements outlined in the Zoning Ordinance except having a <br /> separate water meter for which a variance is applied. <br /> . b. The conditional use permit for plumbing in an accessory building <br /> � . meets all requirements outlined in the Zoning Ordinance. <br /> c. The need for the separate water meter arises from the utility design on <br /> the property where the existing home would have to be torn down for <br /> the plumbing to run on the same meter as the house, creating a <br /> hardship. <br /> d. All new work associated with the new garage and patio is being <br /> conducted in the 250-500' zone. However, hardcover on the property � <br /> � in the 75-250' zone is currently over. Therefore, 1:1 removals are <br /> required for all added hardcover either in the 75-250' or 250-500' zone <br /> or a combination thereof due to a lack of a viable hardship allowing <br /> the hardcover to remain. � <br /> 4. The City Council has considered this application including the findings <br /> and recominendation of the Planning Commission, reports by City staff, <br /> comments by the applicants and the public, and the effects of the proposed <br /> conditional use permits and variances on the health, safety and welfare of <br /> the community. <br /> 5. The City Council finds that the conditions existing on this property are <br /> peculiar to it and do not apply generally to other property in this zoning <br /> � district; that granting the conditional use permits and variances would not <br /> Page2of6 ' <br />
