• • <br /> #05-3135 <br /> December 6,2006 <br /> Page 2 <br /> Staff Comments on Revised Layout <br /> Building Height The revised survey/site plan has the southwesterly wing of the house abutting the <br /> existing grade approximately at elevation 938.5',with a lower floor level continuing to be proposed <br /> at 935.2' as it has been since the earlier reviews, which appears to be within a foot of the existing <br /> house lowest floor elevation. Based on this, it is staffs opinion that the proposed fill is not <br /> contributing to any unusual increased"visibility of structures...as viewed from public waters",one <br /> of the criteria for CUP analysis in Zoning Code Section 78-1250. Assuming no changes from the <br /> house elevation plans reviewed previously, the top-of-parapet elevation of 967' yields a defined <br /> building height of 28.5 feet,meeting the 30' limit. As before,the west yard will be filled so that only <br /> the upper level will be above final grade on that side. <br /> Grading and Drainage. The revised grading plan dated 11-30-06 has been reviewed by the City <br /> Engineer's office and their comments are summarized as follows: <br /> 1) Retaining walls for garage entrance need engineered design. <br /> 2) Drainage easement proposed over neighbor's property must be formally established. <br /> 3) Grading plan along south lot line keeps grading on applicants property and maintains height <br /> of existing boulder retaining wall. <br /> 4) Final grading plan should contain erosion and sediment control information. <br /> The applicant will be required to satisfy the Engineer's concerns. Additionally the resolution has <br /> been drafted to require the incorporation of rain gardens as a method of stormwater runoff <br /> treatment,per the Planning Commission recommendation. The resolution requires that the proposed <br /> drainage easement over the adjacent property at 3155 North Shore Drive must be granted and <br /> recorded with Hennepin County prior to issuance of a building permit for the new residence. <br /> Finally,because the access to the property is over a private easement roadway shared by a number of <br /> adjoining property owners, the applicant is advised to obtain whatever permission or approval is <br /> necessary from the entity that controls the road;2400 cubic yards of fill translates to 240 dump truck <br /> loads, which may have negative impacts from a traffic, noise, and road maintenance/repair <br /> standpoint. <br /> Staff Recommendation <br /> Staff recommends approval of the fill CUP, subject to compliance with the City Engineer's <br /> recommendations and comments. <br /> COUNCIL ACTION REQUESTED <br /> Adopt or amend the attached resolution. <br />
