icL°Ivo CITY OF ORONO RESOLUTION OF THE CITY COUNCIL i. *IL- G NO. 7615 kES H O-` A RESOLUTION APPROVING AN OPTICAL TRANSPORT NETWORKING (OTN) SITE LEASE WHEREAS, the Orono Housing and Redevelopment Authority ("Authority") is a public body corporate and politic, and a political subdivision of the State of Minnesota; and WHEREAS, the Authority is the fee owner of certain real property located at 2700 Kelley Parkway, in the City of Orono, County of Hennepin, State of Minnesota (PID: 33.118.23.12.0007), which is legally described as Lot 1, Block 1, City of Orono Addition, Hennepin County, Minnesota; and WHEREAS, Midcontinent Communications is a South Dakota general partnership that provides telecommunications services in Minnesota and has a principal place of business at 4020 West Cayman Street, Sioux Falls, SD 57107; and WHEREAS, Midcontinent Communications wishes to lease a portion of the Authority's property for the purpose of constructing and maintaining a structure for its OTN facilities to serve customers in and around the City of Orono, which structure will measure approximately 16 x 30 feet, with a seven-foot concrete stoop; and WHEREAS, the terms and conditions of this use of the Authority's property are set forth in that certain Optical Transport Networking (OTN) Site Lease, attached hereto; and NOW, THEREFORE, BE IT RESOLVED by the Orono Housing and Redevelopment Authority Board of Commissioners and the Orono Housing and Redevelopment Authority as follows: 1) The Optical Transport Networking (OTN) Site Lease is approved; and 2) The Authority Board Chair and Executive Director are authorized to execute the Lease and the Memorandum of Lease.
