Zoning File #k1207 <br />Page 3 of 3 <br />d. The current policy practices of the City would not permit <br />the approval of the variances sought by applicant. <br />2. To recommend approval of the variances as amended by this <br />Commission based on the following findings: <br />a. The applicant has reduced hardcover with the new proposal <br />for improvements within the lakeshore yarJ. <br />b. The existing structures were removed as a result of a severe <br />storm that eroded the lakeshore bank and had nothing to do with <br />the improper maintenance of the subject structure. <br />C. There have been no substantial changes in the code since <br />1975 when the LR districts and lakeshore standards were <br />established. <br />d. The City had approved similar variances for the property in <br />1978. <br />e. The steep topography requires special consideration for the <br />residents of the property. <br />f. The applicant's physical limitations as documented by his <br />personal physician's report would prevent his full enjoyment of <br />his original lakeshore property if the deck and shed were not <br />restored to lakeshore yard. <br />Approval is subject to the following conditions: <br />1. Applicants f 1lor p lans for the deck and stairs must be amended to show <br />a deck at a 14' by 10' dimension and a safety stogy: not to exceed 4' by 41. <br />2. 7' by 7' shed to be placed under the proposed 14' by 10' deck must be <br />so placed that applicant can provide screening along the lakeside of the <br />retaining wall level that holds the deck structure. <br />3. Run-off from the roof cf the shed must be directed away from the grade <br />level of the retaining wall and drained to a drainage structure already <br />within the retaining wall substructure or via an independent drainage tile. <br />4. Plantings must be provided adjacent to each of the retaining wall <br />levels to provide the necessary screening and ground cover stablization. <br />5. Based on the addition of 140 s.f. of structural hardcover within the <br />0-75' setback area, applicant must remove 140 s.f. of existing excess <br />hardcover within the 75-250' setback area. <br />
