City of ORONO <br />RESOLUTION OF THE CITY COUNCI I_ <br />NO. 2239 <br />��-. — - <br />WHEREAS, at their regulz r meeting held on July 27, 1987 the Orono <br />City Council considered the revised subdivision application of Rainey <br />Anderson, noting the following findings of fact: <br />1. The property is locate) within the RR-lB Single Family Rural <br />Residential Zoning Distr,.ct requiring a minimum of 2 acres of <br />contiguous dry buildable within each newly created lot. <br />2. The property contai total of. approximately 29.11 acres, of <br />which approximately 20.07 ....res is considered dry buildable. <br />3. The proposed plat contains six lots each exceeding the 2.0 acre <br />minimum lot area requirement. <br />4. Proposed Lots 2 and 3, Block I and Lots 2 and 3, Block 2 require a <br />variance because they do not have frontage on a public roadway. <br />5. All six lots are proposed to front on and access to a private <br />road. Lot 2, Block 1 and Lot 3, Block 2 require a variance because <br />they do not contain the required 200' lot width as measured at the 50' <br />front setback line from the cul-de-sac, but do meet the 200' width <br />standard if private road Outlot B is considered as part of the front <br />lot line. Lot 3, Block 1 requires a variance because it does not have <br />200' of frontage abutting road Outlot B, but floes exceed 200' in all <br />dimensions. <br />6. The private road intended to serve the plat shall be constructed <br />subject to the conditions of a developers agreement to be executed <br />between the City and the developer. Standards for this road are as <br />follows: <br />Right-of-way Minimum Width: 50' <br />Minimum Paved Width: 24' <br />Base: 8" Class 5 100% Crushsd <br />Surface: 3" 2341 Bituminous Surface <br />Cul-de-sac: 50' Minimum Right-of-way Radius <br />40' Minimum Paved Radius <br />7. It is intended that the privates road be privately ov,ned and <br />maintained. The City will require that the developer execute the <br />standard road and utility easement over the private road, and shall <br />execute the standard Declaration of Private Read Easement and <br />Declaration for Maintenance of Same. It is intended that Outlot A be <br />developed as a private road now, and that Outlot B shal 1 be developed <br />at such time that Lot 3, Block 1 is divided into 2 or more tots. <br />Page 2 of 6 <br />
