given the requirements of the statute that have to bt t. <br />The primary issue on this is whether the support of the community <br />to maintain local control is balanced by the sense at the <br />Legislature that the Cities around the lake are trying to achieve <br />exclusivity of the lake and that therefore the authority would be <br />renewed in the future by the Legislature. <br />2. General Condemnation Authority - Prior to this special <br />author_ity being given an this one case to both Hennepin Parks and <br />Metropclitan Council. The Park system was required to obtain the <br />permission of the "host" community prior to exercising eminent <br />domain. While municipalities generally can exercise eminent <br />domain outside its jurisdictional boundries (as evidenced in the <br />Long take sewer plant issue), this was not an authoriLi <br />previously grunted to either Hennepin Parks or Metropolitan <br />Council and would place them in the catagory as it relates <br />eminent domain of municipalities. <br />3. The Garbage Bill Issue - The other issue related to the <br />constitutionality of law suit is the fact that this was concluded <br />in a garbage bill which is specifically prohibited by the State's <br />constitution which limits a bill to one topic. <br />ALTERNATIVES <br />1. Have the City Attorney review the submissions of the two law <br />suits and opine as to relative merits of the case. <br />2. Obtain copies of the lawsuit documents for the Council to <br />have them review and determine their desire to participate based <br />on that review. <br />3. Undertake financial support of the City of Minnetrista <br />directly in their law suit. <br />4. Pledge to undertake an "amicus curiae", friend of the court <br />brief on behalf of the City of Orono in support of Minnetrista. <br />5. Choose not to take any further support at this time. <br />RECOMMENDATION - It is recommended that the City obtain copies of <br />the lawsuits and given the fact that the Popham Haik law firm is <br />the City Attorney for the City of Minnetrista request a very <br />preliminary summary from our City Attorney on the merits of the <br />case submitted by them. It is requested that it bp tabled until <br />such time as the City obtains that and then makes a decision as <br />to the best way to proceed in the matter. <br />PRCPOSED MOTION - Moved by _ seconded by _ the Council <br />requests a summary of issues and the lawsuit from our City <br />Attorney for further consideration and its support. Ayes <br />Nays __ <br />
