MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD SEPTEMBER 28, 1987 <br />#1163 JOHN MCDOWELL <br />1255 WOODHILL AVENUE <br />FINAL SUBDIVISION <br />RESOLUTION #2263 <br />John McDowell and Henry Kingran of the Woodhill Country <br />Club were present for this r meter. <br />City Administrator Bernhardson explained that the <br />developers have completed all preliminary plat approval <br />requirements for the five lot plat of Woodhill Ridge, <br />except for the agreement with the City that would <br />stipulate the applicant's share it the improvement costs <br />for Woodhill Avenue. Staff recommends that final <br />subdivision approval be conditioned upon; a) that the <br />Outlot be combined with Woodhill Country Club property, <br />and b) an agreement on the applicant's share in the <br />Woodhill Avenue improvements. <br />John McDowell voiced his concern with the delay involved <br />with condition "b" noting that he would like to commence <br />road construction prior to the upcoming cold weather. <br />fie stated that he is willing to sign and do whatever is <br />necessary regarding paying their fair share of Woodhill <br />Avenue improvements. <br />Henry Kingman stated that they are also anxious for <br />this project to begin. <br />City Administrator Bernhardson explained that in order <br />to protect the City's liabilities the applicant's "fair <br />share" should be agreed upon prior to construction. <br />Mr. McDowell noted that the main reason for upgrading <br />Woodhill Avenue was based on safety reasons, whereas <br />"all" will bent :. t from the safety standpoint of <br />upgrading Woodhill Ave., not just his development. He <br />felt that the public haaring process could take months <br />to resolve who pays what and what is fair. <br />Mayor Grabek asked if there was some way to protect the <br />City's liability and accomodate Mr. McDowell? <br />City Administrator Bernhardson stated he would be able <br />to better address Mayor Grabek's question after the <br />meeting with Mr. McDowell and his attorney on October <br />1st to discuss the engineer's feasibility study. He <br />also explained the conceivable problems in reaching a <br />"fair share" agreement among all involved i.e. City, <br />applicants, and residents. <br />
