140' width, 1.0 acre area. In 1967, the zoning code established <br />the zone as R-IC, 1 acre/140' width. Under the 1975 zoning code <br />the property was zored LR-1B 1 acre/140' width. This zoning code, <br />which is currently in of:lect, restricts building to lots of one <br />acre or more. <br />As of 1984, in the LR-lB zoning district, there were 657 <br />existing developed single-family residential units. Of those 657 <br />units, 96% are equal or greater to 0.20 acres, 79% are equal to or <br />greater 0.40 acres. Only 4% are less than 0.20 acres. According <br />to the applicable zoning codes, the H-nrichs would require both lot <br />area and lot width variances to build as they desire. The <br />circumstances of the lot would also seem to necessitate a hardcover <br />variance. However, Henrich states that he is willing to stipulate <br />that he will landscape the property in such a way as to comply with <br />the hardcover requirements. <br />C. Planning Commission Action <br />On June 6, 1988, the Planning Commission reviewed <br />Henrich's application and the City Staff recommendations and voted <br />4-0 to der►y the variances. The Planning Commission based its <br />decision on the follo.?ing reasons <br />1. Adding another house to the extensively developed <br />neighborhood will not be keeping with the spirit and <br />intent of the LR-lB zoning district. <br />2. The granting of the lot area and the lot width <br />variances will ultimately lead to requests for <br />variances to average lakeshore setback and hardcover <br />requirements. <br />3. Granting the variances will ultimately have a negative <br />impact on the character of the neighborhood as well as <br />have a negative impact on the quality of water in Lake <br />Minnetonka. <br />4. The applicant has a reasonable use of the property as <br />a s le yard area which he has maintained as part of <br />his pri►iciple residence for more taan 10 years, hence <br />denial of the variances cannot be considered as a <br />taking. <br />In addition, city staff determined that Henrich had not <br />demonstrated undue hardship under the applicable ordinance. <br />
